Welcome to JustHorse. These Terms of Service ("Terms") govern your access to and use of the JustHorse mobile application and any related services (collectively, the "Service").
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
JustHorse is a social platform for horse enthusiasts, allowing users to connect, share content, create and book training sessions, and buy and sell horses and related equipment. We provide these services subject to the following terms and conditions.
Acceptance of Terms
By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian, who must agree to these Terms on your behalf. Certain features, such as payment processing and marketplace transactions, may be restricted to users 18 years and older.
User Accounts
Account Creation
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Security
You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Immediately notifying us of any unauthorized use of your account
One Person, One Account
Each person may maintain only one account. Accounts registered by "bots" or automated methods are not permitted.
Account Termination
We may suspend or terminate your account if:
You violate these Terms or our Community Guidelines
We are required to do so by law
We believe your actions may create liability for JustHorse, other users, or third parties
Your account shows signs of fraud, abuse, or suspicious activity
User Content
Content Ownership
You retain ownership rights to any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant JustHorse a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content in any and all media.
Content Responsibility
You are solely responsible for your User Content. You represent and warrant that:
You own or have the necessary rights to use and authorize JustHorse to use your User Content
Your User Content does not infringe or violate the rights of any third party
Your User Content complies with these Terms and all applicable laws
Community Guidelines
To maintain a safe and supportive community, you agree not to:
Prohibited Content
Post content that is illegal, harmful, threatening, abusive, harassing, or defamatory
Share false, misleading, or deceptive content
Post content that depicts animal cruelty or mistreatment
Share private information about others without consent
Post content that promotes illegal activities
Upload viruses or malicious code
Prohibited Behavior
Impersonate others or misrepresent your affiliation
Engage in harassment, bullying, or intimidation
Use the Service for any illegal purpose
Interfere with or disrupt the Service
Collect personal data about other users without permission
Use automated methods to access the Service
Animal Welfare
As an equestrian community, we prioritize horse welfare. You agree to:
Promote humane treatment of horses in all content
Not share or promote abusive training techniques
Report content that depicts horse mistreatment or neglect
Training Sessions
Session Creation
When creating training sessions, you agree to:
Provide accurate information about the session
Only offer training services you are qualified to provide
Comply with all applicable laws and regulations
Honor bookings made through the platform
Maintain appropriate safety standards
Session Booking
When booking training sessions, you agree to:
Pay the specified fee for the session
Attend as scheduled or cancel within the designated period
Follow all safety instructions provided by the trainer
Accurately represent your and your horse's skill levels
Important Notice
Users participate in training sessions at their own risk. We strongly recommend verifying trainer credentials, using appropriate safety equipment, obtaining appropriate insurance coverage, and following safe horsemanship practices at all times.
Marketplace
JustHorse Marketplace is a platform that allows users to advertise, buy, and sell horses, accessories, trailers, and services. JustHorse does not own the items advertised and is not a party to transactions between buyers and sellers.
Private vs. Business Sellers
On JustHorse Marketplace, you can advertise as a private individual or as a business. Other users can see whether a listing is published by a private seller or a business, which is important as consumer protection laws do not apply to purchases from private individuals.
A business may not advertise as a private individual. JustHorse reserves the right to determine when a listing should be classified as a business listing based on factors such as volume of sales, commercial activity, and professional presentation.
Listing Requirements
When creating listings, you agree to:
Provide accurate and complete descriptions of the item or service
Use only your own photos or photos you have permission to use
Set fair and transparent pricing
Disclose any defects, health issues, or other relevant information
Only list items you legally own and have the right to sell
Remove or mark your listing as sold when the item is no longer available
Not create duplicate listings for the same item
Not include misleading keywords to manipulate search results
Comply with all applicable laws and regulations
Rules for Horse Listings
In accordance with Swedish Djurskyddslagen (Animal Protection Act) and in cooperation with animal welfare organizations:
Registration: Sellers of horses may need to be registered with Jordbruksverket. On request, you must be able to provide your horse's registration number or, for foals, the dam's registration number.
No Free Giveaways: To prevent impulse purchases and ensure responsible ownership, animals cannot be given away for free.
Age Requirements: The horse's age at time of sale/delivery must be clearly stated in the listing.
Health Disclosure: Any known health issues or conditions must be disclosed in the listing.
CITES Species: Listing of certain protected species or products may require permits from Jordbruksverket.
Illegal advertising of animals can lead to fines or imprisonment for the seller.
Prohibited Items and Services
The following are prohibited on JustHorse Marketplace:
Illegal goods or services
Counterfeit, stolen, or pirated items
Dangerous or hazardous goods
Items that infringe on intellectual property rights
Animals that are mistreated, in poor health, or under minimum age requirements
Prescription drugs or veterinary medicines without authorization
Weapons (except legal hunting/sporting equipment with proper licensing disclosures)
Wolf hybrids or other prohibited animal breeds
Used underwear or inappropriate personal items
Content that is offensive, discriminatory, or promotes harmful practices
Featured Listings and Paid Services
JustHorse offers optional paid services to enhance your listings:
Featured Listings: Your listing will be highlighted and shown more prominently
Boost: Temporarily increase visibility of your listing
Payment for these services is processed through Stripe. Misuse of the platform or violation of these terms does not entitle you to a refund and may result in forfeiture of any prepaid credits.
User-to-User Transactions
JustHorse serves only as a venue for buyers and sellers to connect. We are not a party to any transaction between users. When a dispute arises between buyer and seller, the parties should contact each other to resolve the dispute.
JustHorse does not guarantee the quality, safety, legality, or accuracy of listings. You should not assume that an offer, sale, or purchase is valid and legal simply because it appears on JustHorse.
Messaging
When using JustHorse's messaging service to communicate with other users, you agree to:
Communicate respectfully and professionally
Not threaten, harass, or abuse other users
Not send spam, unsolicited marketing, or chain messages
Not use the messaging service for illegal, deceptive, or harmful purposes
JustHorse may filter, remove, or block messages that violate these rules or applicable laws.
Payments and Fees
Payment Processing
We offer two types of payment processing:
Training Sessions and Marketplace: Payments are processed through Stripe, Inc.
In-App Subscriptions: Processed through Apple App Store or Google Play Store.
Subscription Management: Manage via App Store or Play Store settings.
Cancellation: Cancel anytime, effective at end of billing period.
No Partial Refunds: No refunds for unused portions, except as required by law.
Intellectual Property
The Service and its original content, features, and functionality are owned by JustHorse and are protected by international copyright, trademark, and other intellectual property laws.
Subject to these Terms, JustHorse grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial purposes.
Third-Party Links and Services
The Service may contain links to third-party websites or services that are not owned or controlled by JustHorse. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms.
If you wish to terminate your account, you may do so through the app settings or by contacting us.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
JUSTHORSE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT WILL BE ACCURATE, RELIABLE, OR COMPLETE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUSTHORSE SHALL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE.
IN NO EVENT WILL JUSTHORSE'S AGGREGATE LIABILITY EXCEED €100 OR THE AMOUNT YOU PAID IN THE LAST 12 MONTHS.
Dispute Resolution
Informal Resolution
If you have a dispute with JustHorse, please contact us first at support@justhorse.com. We'll try to resolve the dispute informally.
Arbitration
If we cannot resolve a dispute informally, any controversy shall be settled by arbitration administered by the International Chamber of Commerce in Stockholm, Sweden.
Applicable Law
These Terms shall be governed by the laws of Sweden, without regard to its conflict of law provisions.
Changes to Terms
We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice before the changes become effective.
Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
